TopNam Academy LLC (“TopNam Academy,” “we,” “us,” or “our”) operates an educational Software-as-a-Service (SaaS) platform that delivers online training, live calls and an AI application. We are committed to protecting your privacy. This Privacy Policy explains what information we collect from you (“user” or “you”), how we use and share it, and your rights regarding that information. By using our website and services (the “Service”), you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this policy, please do not use the Service.
Information We Collect
We collect only the minimum personal information necessary to provide you with our educational services. This includes information you provide directly to us and information collected by third-party services on our behalf. Below we explain what data is collected and by whom:
1. Personal Information You Provide to Us
When you create an account or make a purchase on our site, you voluntarily provide personal information, including:
- Account Information: We collect your email address, a username or nickname (for your account profile), and a password. This information is collected by TopNam Academy LLC through our website when you register at checkout to access your training.
- QA AutoTest Accelerator / QA AutoTest Interviews and Profile Data: If you fill out any optional profile details or participate in training activities (such as a program progress or quiz results), that information may be stored in your account.
- Communication: If you contact us (for example, via customer support email or contact forms), we will collect your name, email, and any information you choose to provide in your message.
2. Payment and Billing Information (Third-Party Collection)
When you purchase a training, payment and billing details are handled by third-party services for security:
- Payment Details: We do not collect or store your credit card number, debit card number, or bank account information on our servers. All payment information (such as card number, expiration date, CVV, and billing address) is collected and processed directly by our third-party payment processors during checkout. Our saas platform uses WooCommerce for checkout, which securely transmits your payment details to Authorize.net payment processing service. These third-party payment gateways will process your payment information in accordance with their own privacy policies. We receive only limited information about the transaction (such as a confirmation that payment was completed, the payment method type, and possibly the last four digits of your card or a transaction ID).
- Billing Information: If billing address or contact information is required for payment processing, that data is collected by the payment processor (or entered into WooCommerce and passed to the processor). We generally do not store your full billing address in our database; if we do retain any billing contact info (such as for invoicing or record-keeping), it will be noted and protected as personal data.
Please Note: Because third-party payment processors handle your sensitive payment data, we advise you to review the privacy policies of WooCommerce and Authorize.net for details on their data practices. TopNam Academy LLC does not control and is not responsible for how these third parties treat your payment information, but we only partner with reputable processors that are PCI-DSS compliant and secure.
3. Information Collected Automatically
When you visit or use our Service, certain information is collected automatically by us or by service providers on our behalf:
- Usage Data: We (or our analytics providers) may collect information about how you access and use the site. This includes your IP address, browser type, device type, operating system, referring URLs, pages viewed, clicks, and the dates/times of access. This data is typically collected through server logs and cookies or similar tracking technologies (described in the Cookies section below).
- Cookies & Similar Technologies: Our website uses cookies and similar tracking technologies to remember your preferences, keep you logged in, and collect analytics data. Cookies are small text files placed on your device. For details on what cookies we use and why, see Cookies and Tracking Technologies below.
- Analytics Data: We use third-party analytics tools (such as Google Analytics) to gather information about site usage. These tools automatically collect data like your IP address, user agent, and engagement with our site (e.g., which pages you visit, time spent). This information helps us understand user behavior and improve our Service. Google Analytics may set its own cookies to perform these services.
- Advertising/Tracking Data: If we use advertising pixels or tags (for example, the Meta Pixel from Facebook/Meta), those third parties may collect data about your visit (such as which pages you visited or if you completed a purchase) for the purposes of ad targeting and measuring the effectiveness of our ads on their platforms. This data might include hashed identifiers or cookies that enable us to show you relevant ads on other platforms. We do not share your name or contact information with these third-party advertising partners, but the tracking technologies may indirectly identify you through your device. We do not intentionally collect any sensitive personal information (such as social security numbers, government ID details, or biometric data) through our platform. We also do not knowingly collect personal information from children under the age of 13 (see Children’s Privacy below).
How We Use Your Information
We use the collected information to operate, provide, and improve our Service. We strive to use your data only for legitimate and intended purposes. Specifically, TopNam Academy LLC may use your personal information for the following purposes:
- Providing and Improving the Service: To create and manage your user account, authenticate you at login, and allow you to access the training and content you have purchased. We use your information to deliver training materials, track your progress, and improve your learning experience.
- Processing Transactions: To process your training purchases, subscriptions, or other orders. Your email and account ID are used to link your purchase to your account, and third-party payment processors use your payment information to complete the transaction. We also send you purchase confirmations, invoices, or receipts via email.
- Communications: To communicate with you about your account or transactions. For instance, we may send you service-related announcements, such as payment confirmations, training enrollment details, password reset emails, or important updates about the platform (e.g., changes to your training or this Privacy Policy). We may also respond to your inquiries or support requests using the information you provided.
- Marketing and Updates (Opt-in): If you opt in to receive marketing communications (such as newsletters or promotional offers), we will use your email to send you updates about new trainings, features, or promotions that may interest you. You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in the email or contacting us. (We will not send you promotional communications if you have not opted in or if it is not permitted by law.)
- Analytics and Service Improvement: To analyze user interactions and usage trends in order to improve our website design, content offerings, and overall user experience. For example, we use Google Analytics to understand which pages or Our Services are most popular and how users navigate the site, so we can make informed decisions about enhancements.
- Security and Fraud Prevention: To protect the integrity of our Service, your account, and other users. We may use information (like IP addresses or activity logs) to detect, investigate, and prevent fraudulent transactions, spam, abuse, security incidents, and other harmful activity. This helps us keep our platform safe and secure.
- Legal Obligations: To comply with applicable legal requirements, such as maintaining proper business records, handling chargebacks or tax records for purchases, or responding to lawful requests by public authorities (e.g., court orders, subpoenas, or regulatory requests). If necessary, we may use and retain your information to enforce our Terms of Use or to defend against legal claims.
- Other Purposes (with Notice/Consent): If we intend to use your personal information for any purpose not covered above, we will provide you with an explanation at the time of collection or seek your consent as required. For instance, if we ever wanted to use a testimonial you provided, we would ask for your permission.
Legal Bases for Processing (GDPR): If you are located in the European Economic Area (EEA) or the United Kingdom, we process your personal data on the following legal bases: (i) Contract – as necessary to provide you with the Service you requested (e.g. to deliver training and process payments, per Article 6(1)(b) GDPR); (ii) Legitimate Interests – for our legitimate business interests in improving our services, securing our platform, and communicating with you (Article 6(1)(f)), and we ensure these interests do not override your privacy rights; (iii) Legal Obligation – to comply with laws and regulations (Article 6(1)(c)); and (iv) Consent – where we explicitly ask for your consent, such as for optional marketing emails or certain cookies (Article 6(1)(a)). You have the right to withdraw consent at any time where consent was the basis of processing.
Information Sharing and Disclosure
We value your privacy and do not sell your personal information to third parties for monetary gain or for their own marketing purposes. TopNam Academy LLC does not and will not sell personal data, and we have not sold any personal information ever. We only share your information in the following circumstances, and always with appropriate safeguards and only to fulfill the purposes described in this policy:
- Service Providers: We share your information with third-party service providers and vendors who perform services on our behalf and need access to certain data to carry out their work. These include:
- Payment Processors: As described above, our payment partners (Authorize.net and Bank of America) receive your payment and billing information directly to process payments. They use this information solely for payment processing and fraud prevention.
- E-commerce Platform (WooCommerce): WooCommerce, the WordPress plugin we use for our online store/checkout, will handle your order details and facilitate the transfer of payment data to the payment gateway. WooCommerce may store order metadata (such as your order number, purchase date, and your email) on our site. This data remains under our control, though WooCommerce (Automattic) as a software provider does not directly access individual order data except as needed for support or if you opt into certain features.
- Learning Management System: WordPress LMS plugin that delivers our training program. LMS itself stores your progress, quiz scores, and similar data on our servers. This information is accessible to us to manage your training, but is not shared with outside parties by LearnDash. (It is internal to our platform.)
- Analytics Providers: We use Google Analytics to collect usage data as described in Information Collected Automatically. Google Analytics is provided by Google LLC, which processes usage data (e.g., pages visited, IP addresses) on our behalf for analytics purposes. We have configured Google Analytics to anonymize IP addresses where applicable. The data Google Analytics collects may be transmitted to and stored on Google’s servers (e.g., in the United States). We may also use other analytics or monitoring tools that need access to certain usage information. These providers are restricted from using your data for any purpose other than providing services to us.
- Advertising Partners: If we utilize advertising or retargeting services such as Meta (Facebook) Pixel, we may share hashed identifiers or allow those partners to collect information via cookies/pixel on our site. This enables us to reach you with relevant ads on their platforms. For example, Meta may receive information that you visited our site or performed a certain action (like buying a QA AutoTest Accelerator/ QA AutoTest Interviews) so that we can measure ad effectiveness or build a relevant audience. We do not give these partners your direct personal details like your name or email, but the information collected through tracking technologies could be associated with you by the third-party if you have an account with them. You can opt out of this kind of sharing via cookie preferences or as described in Cookies and Tracking Technologies.
- Email Service Providers: If we use an email service (e.g., an SMTP relay or marketing email service like MailChimp or SendGrid) to send communications, your name and email address may be shared with that provider solely for the purpose of sending the emails you subscribed to or transactional emails (like receipts or password resets). They are not allowed to use your email for their own purposes.
- Web Hosting and IT: Our website is hosted on servers (or cloud services) provided by third-party hosting companies. Personal data you provide is stored on those servers. Our hosting provider and technical support contractors may have incidental access to data when performing maintenance or troubleshooting the site, but they are bound by confidentiality and data protection obligations.
- Business Transfers: If TopNam Academy LLC is involved in a merger, acquisition, sale of assets, or reorganization, your personal information may be transferred to the successor or new owner as part of that transaction. In such a case, we will ensure the new owner is bound by terms that protect your data in a manner consistent with this Privacy Policy, and we will notify you (for example, via email or a notice on our website) of any change in ownership or use of your personal information, as well as any choices you may have regarding that information.

- With Your Consent: In situations where you have explicitly given us consent to share your information with third parties, we will do so in accordance with that consent. For example, if you agree to let us share your testimonial on our website, or you use integrations that request data sharing, we will share data as needed with your permission. You have the right to revoke such consent at any time.
No Selling of Personal Data: We reiterate that we do not sell or rent your personal information to data brokers or third parties for their independent use. We may share data with third parties only as described above and always for business or operational purposes, not for profit. In other words, any sharing of data is solely for providing and enhancing our Service (which may include advertising our own Service) or as required by law, and not for the third party’s commercial benefit beyond the service they provide to us.

Our website uses cookies and similar tracking technologies to ensure our Service functions correctly, to enhance your experience, and to collect usage analytics. This section explains how we use these technologies and your choices regarding them.
What Are Cookies?

- Advertising and Tracking Pixels: If we advertise on platforms like Facebook or Instagram, we have integrated the Meta Pixel (Facebook Pixel) on our site. This pixel is a small snippet of code that can drop a cookie or use existing cookies to track visitor activity. It allows us to understand the effectiveness of our Facebook ads and to reach people who have visited our site when they use Facebook/Instagram. The Meta Pixel may record information such as your Facebook User ID (if you are logged into Facebook while browsing our site), your IP address, and which pages you visited or actions you took (like purchasing a training). User Rights and Choices
You have certain rights and choices regarding your personal information. We strive to provide you with access and control so you can manage your privacy. In this section, we outline the rights that all users have, followed by additional rights for users in specific jurisdictions like the European Union (GDPR) and California (CCPA).

- Access and Update: You may access and update certain account information directly by logging into your account settings. For example, you can change your email or update your display nickname. If any personal information we have is inaccurate or has changed, please correct it in your account or contact us to request an update or correction.
- Account Deletion: You can request deletion of your account and personal data at any time. If you wish to close your account and have us delete (or anonymize) the personal information associated with it, please contact us (see Contact Us section). We will take reasonable steps to honor your request, except where we are required to retain certain information by law (for example, transaction records for financial reporting or legal compliance) or for legitimate business purposes (such as fraud prevention).
- Email Preferences: If you have subscribed to marketing communications, you can opt out by clicking the “unsubscribe” link in those emails or adjusting your email preferences in your account settings. Note that you will still receive transactional or account-related emails (e.g., purchase confirmations, password resets) even if you opt out of marketing emails, as those are necessary for service.
- Cookie Choices: As described in Cookies and Tracking Technologies, you can control or block cookies through your browser settings or other tools. You can also opt out of certain tracking or advertising as explained above.
- Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you our services, provide a different level of service, or charge a different price (except where the data in question is necessary for the service, or as permitted by law, such as offering a financial incentive that you have the option to accept or decline).
Rights Under the GDPR (EEA/UK Users)
If you are located in the European Economic Area (EEA) or a jurisdiction with similar data protection laws (such as the United Kingdom), you have certain rights under the General Data Protection Regulation (GDPR) or applicable law. These include:
- Right to Access: You have the right to request a copy of the personal data we hold about you, as well as information on how we process it. This is sometimes called a “Data Subject Access Request.” We will provide you with a copy of your data in a commonly used format, usually within one month of your request (unless an extension is needed).
- Right to Rectification: If any personal data we have is incorrect or incomplete, you have the right to request that we correct or update it. For instance, if you believe we have an outdated email or an incorrect nickname, please let us know.
- Right to Erasure: Also known as the “Right to be Forgotten,” you can ask us to delete your personal data. We will erase the information we have about you upon request, provided we do not have a compelling legal basis to continue processing it (for example, ongoing contractual relations, legal obligations to retain certain data, or legitimate interests that are not overridden by your rights). We will also inform our service providers to delete your data where applicable.
- Right to Restrict Processing: You have the right to request that we limit the processing of your data in certain circumstances. For example, if you contest the accuracy of your data or have objected to our processing, you can ask that we restrict use of the data until the issue is resolved. When processing is restricted, we can still store your data but will not use it for other purposes without your consent (unless required by law).
- Right to Object: You have the right to object to our processing of your personal data when the processing is based on our legitimate interests (including profiling based on those interests). If you object, we will stop processing your data for that purpose unless we have a strong overriding legitimate reason to continue or if it is needed for legal claims. You also have the right to object at any time to processing of your data for direct marketing purposes. If you object to marketing, we will cease marketing communications to you promptly.
- Right to Data Portability: You have the right to obtain your personal data that you provided to us in a structured, commonly used, and machine-readable format, and you have the right to transmit that data to another controller (for example, to another service), where technically feasible. This right applies when the processing is based on your consent or a contract and is carried out by automated means. We will assist in providing your data in a transferable format if you request it.
- Right Not to Be Subject to Automated Decisions: We do not make any significant decisions about you based solely on automated processing (i.e., without human involvement). However, you have the right not to be subject to a decision based only on automated processing, including profiling, if that decision produces legal effects or similarly significant effects for you.
- Right to Withdraw Consent: In cases where we rely on your consent to process personal data (for example, for optional marketing emails or non-essential cookies), you have the right to withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal. If you withdraw consent for a specific feature (like analytics cookies via the cookie settings), we will stop that processing.
- Right to Complaint: If you have concerns about our data practices, you have the right to lodge a complaint with a supervisory authority (data protection authority) in your country of residence, place of work, or where the incident took place. For example, if you are in the EU, you can contact the data protection authority in your country. We would, however, appreciate the chance to address your concerns directly before you do this, so please feel free to contact us with any issues.
To exercise any of these GDPR rights, please contact us using the information in the Contact Us section. We may need to verify your identity before fulfilling certain requests (to ensure that we don’t disclose data to the wrong person). We will respond to your request within the timeframe required by law (generally within one month for GDPR requests, with the possibility of extension if needed).
California Privacy Rights (CCPA/CPRA)
If you are a resident of California, you are protected by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). Even though TopNam Academy LLC may not meet all the thresholds to be mandated by CCPA, we aim to honor these rights for California residents. These rights include:
- Right to Know: You have the right to request that we disclose what personal information we collect, use, disclose, and sell (if applicable) about you. This includes the specific pieces of information we have about you, as well as the categories of personal information collected, the categories of sources of that information, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it. We have included much of this information in this Privacy Policy. You may also request a more detailed report up to twice in a 12-month period, and we will provide it free of charge.
- Right to Delete: You have the right to request that we delete personal information we have collected from you (and direct our service providers to do the same). Upon receiving and confirming a verifiable deletion request, we will delete (and instruct our service providers to delete) your personal information from our records, except in cases where retaining the information is necessary for us or our service providers to: complete the transaction or provide the service you requested, detect security incidents or prevent fraud, exercise free speech or another legal right, comply with legal obligations (such as record-keeping), or other exceptions permitted by CCPA. We will inform you of any information we cannot delete due to such exceptions.
- Right to Opt-Out of Sale or Sharing: The CCPA gives consumers the right to opt out of the “sale” of their personal information. As noted, we do not sell your personal information for money. We also do not share personal information for cross-context behavioral advertising in a way that would be deemed a “sale” or “sharing” under California law.Â
- Right to Correct: Under CPRA (effective January 2023), California residents also have the right to request correction of inaccurate personal information. If you believe any information we hold about you is incorrect, please let us know and we will take steps to verify and correct it.
- Right to Limit Use of Sensitive Personal Information: CPRA introduces a right to limit the use of “sensitive personal information” if a business uses it for certain secondary purposes. We do not collect or use sensitive personal information (like Social Security numbers, driver’s license numbers, precise geolocation, etc.) for purposes beyond what is necessary to provide our services (for example, payment card details are handled only for completing transactions). Therefore, this right is not applicable to our current practices.
- No Financial Incentive Discrimination: We do not offer financial incentives for your data (e.g., we don’t have a program that gives you a discount for allowing us to sell your data). And as mentioned, we will never discriminate against you for exercising your CCPA rights.
Exercising Your California Rights: If you are a California resident and wish to exercise your Right to Know, Delete, or Correct, please submit a verifiable request to us. In your request, please indicate that you are a California resident exercising your CCPA rights and specify which right you wish to exercise. We will need to verify your identity (and California residency) to process certain requests, which may involve asking you to provide additional information or to confirm information we already have on file (this is to ensure we protect your data from unauthorized access). We will respond to your request within 45 days as required by CCPA (and if needed, we’ll let you know if we need an extra 45 days). Requests to opt out of sales will be handled promptly (though as noted, we do not sell data). If you have an authorized agent making a request on your behalf, we will require proof of the agent’s authority and verification of your identity.
Other Jurisdictions
If you are located in other states or countries, you may have similar rights under local laws (for example, certain U.S. states like Virginia, Colorado, etc., have privacy laws coming into effect). We intend to respect applicable laws. You may contact us to inquire about your personal data or rights, and we will do our best to accommodate your request in line with applicable regulations. We will update this Privacy Policy to reflect additional rights as new privacy laws come into effect.
Data Security
We take the security of your personal information seriously. TopNam Academy LLC implements a variety of technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. These measures include:
- Encryption: We use encryption protocols such as HTTPS/TLS (SSL) to secure data in transit between your browser and our website. This means that information you send to us (like your login credentials or any form inputs) is encrypted during transmission. For sensitive interactions like payment, our payment processors also use strong encryption to protect your data.
- Access Controls: Our user database is protected by authentication and access controls. Only authorized personnel with a valid business need have access to personal data, and they are required to keep that information confidential. Passwords are stored in hashed form (we never store your password in plain text), and we urge you to choose a strong password and keep it confidential.
- Security Testing and Maintenance: We keep our website software updated to patch security vulnerabilities. We utilize security plugins and firewalls to monitor for suspicious activity and prevent common web attacks. We also periodically review our security practices and may engage in vulnerability scanning or penetration testing to strengthen our defenses.
- PCI Compliance: For payment processing, we rely on PCI-DSS compliant service providers (Authorize.net and WooCommerce). We ourselves adhere to best practices for e-commerce security by not storing sensitive financial data and by following WooCommerce security guidelines.
- Employee Training: Our team members are trained on data privacy and security principles. We limit access to personal information to those employees and contractors who need it to perform their job duties, and they are bound by confidentiality obligations.
